Instructor Revenue Share

This article details the Tune-Up Skills revenue-sharing plan for instructors.

At Tune-Up Skills, we strive to build a sustainable partnership where instructors are rewarded for creating career-enhancing content and attracting professionals to the platform, while Tune-Up Skills is compensated for driving sales.

Creating and publishing career-advancing content on Tune-Up Skills is completely free. Instructors can create and offer both free and paid courses without any limitations.

Instructor Revenue Share Outlook

Instructors are encouraged to review the Instructor Terms for a comprehensive understanding of Tune-Up Skills revenue-sharing model.

Below is a high-level summary of the plan:

Tune-Up Skills’ revenue share is based on the Net Amount, which is the student’s payment minus any applicable taxes or fees charged by platforms like Apple or Google for sales made on iOS and Android.

Sales from instructor promotions: Instructors receive 70% of the revenue when a student purchases their content using the instructor’s referral link or coupon code.

Sales without instructor promotions: Instructors receive 40% of the revenue for sales where no referral link or coupon code was used. These include organic sales driven by Tune-Up Skills’ marketing efforts.

Revenue distribution: The above structure outlines the revenue share between Tune-Up Skills and instructors for a specific sale. It does not account for any additional revenue sharing an instructor may have allocated for co-instructors. A Co-instructor is exclusively a business relationship between a registered instructor and a trusted person the instructor chooses to be in a co-instructor relationship with. Tune-Up Skills will only have a contractual relationship with the instructor.

Open Revenue Report (OPR)

Instructors have full access to track their sales through the Open Revenue Report. This report provides key details, including the student’s name, purchase date, and the total amount paid.

Instructor Terms

By signing up as an instructor on the Tune-Up Skills platform, you agree to comply with these Instructor Terms (“Terms”). These Terms outline key aspects of the Tune-Up Skills platform relevant to instructors and are incorporated by reference into our Terms of Use, which govern the overall use of our services. Any capitalized terms not defined within these Terms will have the meanings assigned in the Terms of Use.

As an instructor, you are entering into a direct contract with Tune-Up Skills, a training platform owned by Abidorch Consultancy Inc. a corporation based in Canada. Abidorch will also facilitate payments to you.

  • Instructor Obligations

As an instructor, you are responsible for all content you post, including lectures, quizzes, coding exercises, practice tests, assignments, resources, answers, course landing page content, labs, assessments, and announcements (“Submitted Content”).

You represent and warrant that:

  • You will provide and maintain accurate account information.
  • You own or have the necessary licenses, rights, consents, permissions, and authority to authorize Tune-Up Skills to use your Submitted Content as specified in these Terms and the Terms of Use.
  • Your Submitted Content does not infringe or misappropriate any third party’s intellectual property rights.
  • You have the required qualifications, credentials, and expertise (including education, training, knowledge, and skills) to teach and offer the services you provide through your Submitted Content.
  • You will maintain a quality of service that aligns with industry standards and best practices for instructional services.

You warrant that you will not:

  • Post or provide any content that is inappropriate, offensive, racist, hateful, sexist, pornographic, false, misleading, infringing, defamatory, or libelous.
  • Share unsolicited or unauthorized advertisements, promotional materials, spam, or any other form of solicitation through the Services or to any user.
  • Use the Services for any purpose other than providing tutoring, teaching, and instructional services to students.
  • Engage in any activity that would require Tune-Up Skills to obtain licenses from or pay royalties to a third party, including royalties for the public performance of musical works or sound recordings.
  • Frame or embed the Services (such as embedding a free version of a course) or otherwise attempt to bypass or circumvent the platform.
  • Impersonate another person or gain unauthorized access to another user’s account.
  • Interfere with or prevent other instructors from providing their services or content.
  • Abuse Tune-Up Skills ’s resources, including support services.
  • License to Tune-Up Skills

By submitting content to Tune-Up Skills, you grant Tune-Up Skills the rights outlined in the Terms of Use to offer, market, and otherwise utilize your Submitted Content. This includes:

  • The right to add captions or make modifications to ensure accessibility.
  • The ability to sublicense your Submitted Content to third parties, including students directly and external partners such as resellers, distributors, affiliate sites, deal platforms, and paid advertising providers.
  • The right to apply generative and non-generative AI models to your Submitted Content to enhance core platform capabilities like search and recommendations.

Content Removal Rights

  • You may remove all or part of your Submitted Content from Tune-Up Skills at any time, unless otherwise agreed.
  • Tune-Up Skills right to sublicense your Submitted Content to new users will terminate 90 days after removal. However:
    • Students who accessed your content before removal will retain their rights in accordance with their licenses (including lifetime access).
    • Tune-Up Skills may continue using your Submitted Content for marketing purposes even after removal.

Marketing and Quality Control

  • Tune-Up Skills may record and use any part of your Submitted Content for quality control, as well as for delivering, marketing, promoting, demonstrating, and operating its Services.
  • You grant Tune-Up Skills permission to use your name, likeness, voice, and image for the marketing and promotion of the Services, your Submitted Content, and Tune-Up Skills content.
  • To the extent permitted by law, you waive any rights of privacy, publicity, or similar protections regarding such use.

3. Trust & Safety

3.1 Trust & Safety Policies

By using Tune-Up Skills Services, you agree to comply with Tune-Up Skills Trust & Safety Policies, Restricted Topics policy, and any other content quality standards or policies established by Tune-Up Skills. These policies may be updated periodically, and it is your responsibility to review them regularly to ensure compliance.

Your access to and use of the Services is subject to Tune-Up Skills approval, which may be granted or denied at our sole discretion.

Enforcement Actions

Tune-Up Skills reserves the right to remove content, suspend payouts, and/or ban instructors at any time, without prior notice, for any reason, including but not limited to:

  • Policy Violations – The instructor or their content does not comply with Tune-Up Skills policies or legal terms (including the Terms of Use).
  • Quality Standards – The content does not meet Tune-Up Skills quality standards or negatively impacts the student experience.
  • Reputation Risk – The instructor engages in behavior that could harm Tune-Up Skills reputation or subject it to public disrepute, contempt, scandal, or ridicule.
  • Third-Party Violations – The instructor collaborates with marketers or business partners who violate Tune-Up Skills policies.
  • Unfair Competition – The instructor uses Tune-Up Skills platform in a way that constitutes unfair competition, such as promoting an off-site business in violation of Tune-Up Skills policies.
  • Other Violations – Any other actions deemed inappropriate by Tune-Up Skills at its sole discretion.

3.2 Co-Instructors and Teaching Assistants

The Tune-Up Skills platform allows you to add co-instructors or teaching assistants to help manage your Submitted Content. When doing so, you must comply with Tune-Up Skills Co-Instructor Relationship Rules and Guidelines.

By adding a co-instructor or teaching assistant, you acknowledge and accept that:

  • They are authorized to perform certain actions that may impact your Tune-Up Skills account and Submitted Content.
  • Any violations of Tune-Up Skills terms or policies by your co-instructors or teaching assistants may also affect your account and content.
  • Tune-Up Skills does not mediate disputes between instructors and their co-instructors or teaching assistants.

If a co-instructor is assigned a revenue share, their portion will be deducted from your earned revenue based on the ratios specified in your Course Management settings at the time of purchase.

3.3 Relationship with Other Users

As an instructor, you do not have a direct contractual relationship with students. The only student information you will receive is what is provided to you through the Tune-Up Skills platform.

You agree that:

  • You will only use student data for the purpose of providing your services on the Tune-Up Skills platform.
  • You will not request, collect, or store additional student data outside of Tune-Up Skills platform.

You also agree to indemnify Tune-Up Skills against any claims, liabilities, or damages arising from your use, misuse, or mishandling of students’ personal data

4.0 Transaction Taxes

If a student purchases a product or service in a country where Tune-Up Skills is required by law to remit national, state, or local sales taxes, value-added tax (VAT), or other transaction taxes (“Transaction Taxes”), Tune-Up Skills will collect and remit these taxes to the appropriate tax authorities.

  • Price Adjustments – Tune-Up Skills may increase the sale price at its discretion if it determines that Transaction Taxes apply.
  • Mobile Purchases – For purchases made through mobile applications, applicable Transaction Taxes are collected by the mobile platform (such as Apple’s App Store or Google Play).

5. Payments

5.1 Revenue Calculation and Payment

When a student purchases your Submitted Content, we calculate the Gross Amount of the sale as the amount received by Tune-Up Skills from the student. From the Gross Amount, we subtract the following to determine the Net Amount:

  • Transaction Taxes
  • Mobile platform fees (for sales made through mobile provider checkouts, such as Apple’s App Store or Google Play)
  • A 4% service and processing fee (for non-mobile provider checkout sales) or a 5% fee for sales in Japan
  • Any amounts paid to third parties in connection with Instructor Programs

Revenue Share

  • If you do not participate in any of Tune-Up Skills optional Instructor Programs, your revenue share will be 40% of the Net Amount, less any applicable deductions (such as student refunds), and excluding sales through instructor-generated coupon codes or course referral links.
  • If we change the payment rate, we will provide you with 30 days’ notice via email or other prominent means, such as posting a notice in our Services.
  • If you participate in any Instructor Programs, your revenue share may differ and will be specified in the Promotions Policy.

Payment Details

  • Payments are made in Canadian dollars (CAD), regardless of the currency in which the sale was made.
  • Tune-Up Skills is not responsible for any foreign currency conversion fees, wiring fees, or other processing fees you may incur.
  • Your open revenue report will display the sales price in local currency and your converted revenue amount in USD.

5.2 Instructor Coupons and Course Referral Links

The Tune-Up Skills platform allows you to create coupon codes and referral links that offer discounts, Tune-Up Skills current price, or free access to certain items of your Submitted Content for students. These coupon codes and referral links are subject to specific limits. You are not permitted to sell these codes on third-party websites or offer them in exchange for compensation. Additional details and restrictions on coupon codes and referral links can be found in our Trust & Safety policies.

When a student uses your coupon code or referral link at checkout, your revenue share will be70% of the Net Amount, minus any applicable deductions such as student refunds.

5.3 Receiving Payments

To receive payments in a timely manner, you must:

  • Own a PayPal account or a Canada bank account (for Canadian residents only) in good standing.
  • Keep your correct email associated with your account up to date.
  • Provide any identifying information or tax documentation (such as HST) required for payment.

You agree that Tune-Up Skills has the right to withhold appropriate taxes from your payments and that failure to provide proper identifying information or tax documentation may result in withheld payments or penalties.

You understand that you are ultimately responsible for any taxes on your income.

Payment Timing and Eligibility

Depending on the applicable revenue share model, payments will be made within 45 days of the end of the month in which:

  • (a) We receive the fee for a course, or
  • (b) The relevant course consumption occurred.

As an instructor, you are responsible for determining whether you are eligible to be paid by a Canadian company. We reserve the right to withhold payment if there is identified fraud, violations of intellectual property rights, or other violations of the law.

If we are unable to settle funds into your payment account after the period set forth by your state, country, or other governing authority in its unclaimed property laws, we may process the funds in accordance with our legal obligations, including submitting those funds to the appropriate government authority as required by law.

5.4 Refunds and Revenue Adjustments

You acknowledge and agree that students have the right to request a refund, as outlined in the Terms of Use. Instructors will not receive any revenue from transactions for which a refund has been granted under these terms.

If a student requests a refund after the relevant instructor payment has been made, we reserve the right to:

  • Deduct the refund amount from the next payment sent to the instructor, or
  • If no further payments are due to the instructor or the payments are insufficient to cover the refund, require the instructor to refund the amount refunded to students for their Submitted Content.

6. Deleting Your Instructor Account

Instructions on how to delete your instructor account will be provided via Customer Support Center. We will make commercially reasonable efforts to ensure any remaining scheduled payments owed to you are processed before deleting your account.

Please note that, if students have previously enrolled in your Submitted Content, your name and that content may remain accessible to those students even after your account is deleted.

Terms of Use

Please review these Terms carefully, as they constitute an enforceable contract between you and Tune-Up Skills. They contain important information regarding your legal rights, remedies, and obligations.

IF YOU RESIDE IN THE UNITED STATES OR CANADA, by agreeing to these Terms, you agree to resolve any disputes with Tune-Up Skills in small claims court or through binding individual arbitration only, and you waive the right to participate in any class actions or have claims decided by a jury.

Tune-Up Skills mission is to improve lives through learning and make them opportunity ready with needed practical skills.. We empower anyone, anywhere, to create and share educational content (instructors) and provide access to that content for learning (students). We believe that our marketplace model is the best way to deliver valuable educational content to users. To keep our platform and services safe for all, including our student and instructor community, we have set rules. These Terms apply to all activities on the Tune-Up Skills website, mobile applications, TV applications, APIs, and other related services (“Services”).

If you publish a course on the Tune-Up Skills platform, you must also agree to the Instructor Terms. We also provide details about how we process personal data for students and instructors in our Privacy Policy.

To engage in most activities on the Tune-Up Skills platform, you need to create an account. Protect your password, as you are responsible for all activities linked to your account. If you suspect unauthorized access, immediately contact our Support Team.

Account Requirements

  • An account is necessary to purchase, access content, or submit content for publication.
  • You must provide and maintain accurate and complete information, including a valid email address.
  • You are fully responsible for all activities under your account, including any harm or damage caused by unauthorized access.
  • You cannot transfer your account to another person or use someone else’s account.
  • If a user passes away, their account will be closed.

Security and Unauthorized Access

  • Do not share your login credentials with anyone.
  • Tune-Up Skills will not intervene in disputes arising from shared account credentials.
  • If you suspect unauthorized access, report it to our Support Team immediately. We may require proof of identity before granting access to an account.

Age Restrictions

  • You must be at least 18 years old to create an account.
  • If you are under 18 but meet the minimum age of consent for online services in your country (e.g., 13 in the U.S., 16 in Ireland), you may not create an account, but a parent or guardian can create one for you and help you access appropriate content.
  • If you are below the minimum age of consent, you cannot create an account or use Tune-Up Skills Services, even with parental consent.
  • Any accounts found in violation of these age rules will be terminated.
  • Instructors may be required to verify their identity before publishing content.

Account Termination

You can delete your account at any time by following the instructions given to you from Support Team

2. Content Enrollment and Lifetime Access

When you enroll in a course or other content on Tune-Up Skills, you receive a license to view it via Tune-Up Skills Services. You do not own the content, nor can you transfer, resell, or distribute it in any way.

License Terms

  • Content is licensed, not sold.
  • You receive a limited, non-exclusive, non-transferable license to access and view the content.
  • The content is for personal, non-commercial, educational use only.
  • You may not:
    • Reproduce, redistribute, transmit, assign, sell, rent, or share the content.
    • Modify, adapt, edit, create derivative works, sublicense, or broadcast the content.
    • Use Tune-Up Skills APIs to access or distribute content without permission.

Lifetime Access

  • You generally receive lifetime access to enrolled content.
  • However, Tune-Up Skills reserves the right to revoke access if:
    • The content is removed for legal or policy reasons (e.g., copyright complaints, Trust & Safety violations).
    • You enrolled via a Subscription Plan, which may have different access terms.
    • The instructor chooses to stop offering add-on features such as Q&A or teaching assistance.

Instructor Licensing

  • Instructors cannot directly grant licenses to students.
  • Any such direct license is null and void and violates Tune-Up Skills ‘s Terms.
  • When instructors publish content on Tune-Up Skills, they grant Tune-Up Skills the right to sublicense it to students.

By enrolling in a course, you agree to comply with these terms and respect the content usage limitations set by Tune-Up Skills.

  • Payments, Credits, and Refunds

3.1 Pricing

  • Content prices on Tune-Up Skills are based on Instructor Terms and the Promotions Policy.
  • Prices may differ between the website, mobile, and TV apps due to platform provider pricing policies.
  • Tune-Up Skills runs promotions and sales, offering discounted prices for a limited time.
  • Prices may vary depending on whether you are logged in or a new user.
  • The displayed currency is based on your account location (if logged in) or current location (if not logged in).
  • If applicable, sales tax, VAT, or GST may be included in the price or added at checkout.

3.2 Payments

  • You agree to pay the listed fees for the content you purchase.
  • Tune-Up Skills processes payments through various methods (credit/debit cards, interac etc).
  • If your payment method fails, you must complete the payment within 30 days.
  • Tune-Up Skills reserves the right to disable access to unpaid content.

3.3 Refunds and Refund Credits

  • You may request a refund within 30 days of purchase (except for Subscription Plans).
  • Refunds may be issued as credits or refunded to your original payment method based on platform policies.
  • Refunds will not be granted after 30 days, except in cases of:
    • Legal or policy violations (e.g., copyright takedowns).
    • Confirmed account fraud or other exceptional circumstances.
  • Refund credits:
    • Automatically applied to future purchases.
    • Expire if not used within the specified period.
    • Cannot be used on mobile or TV apps.
  • Abuse of the refund policy (e.g., excessive refunds, consuming most of the content before refunding) may result in:
    • Refund denial
    • Future refund restrictions
    • Account ban

3.4 Gift and Promotional Codes

  • Tune-Up Skills and partners may offer gift and promotional codes.
  • Codes may be redeemed for:
    • Credits applied to your Tune-Up Skills account (usable for website purchases only).
    • Specific content directly.
  • Credits may expire and generally cannot be refunded for cash.
  • Partner-issued codes follow partner refund policies.
  • Tune-Up Skills may determine which of your multiple saved credits will apply first.

When you make a payment, you agree to use a valid payment method. If you aren’t happy with your content, Tune-Up Skills offers a 30-day refund or credit for most content purchases

Content and Behavior Rules

4.1 Lawful Use

  • You may only use Tune-Up Skills for lawful purposes and must follow local and national laws.
  • You are responsible for all content you post, including reviews, questions, courses, and other materials.
  • Violating Trust & Safety Guidelines or intellectual property rights can result in account suspension or banning.
  • If you believe someone is infringing your copyright, report it to Tune-Up Skills.

4.2 Student & Instructor Conduct

  • Students may ask instructors questions, post reviews, and submit homework/tests, but must not submit plagiarized work.
  • Instructors can upload content and interact with students but must respect intellectual property laws.
  • Any illegal, inappropriate, or objectionable content may be removed.

4.3 Account Suspension & Termination

  • Tune-Up Skills may suspend or terminate accounts for:
    • Law violations or policy breaches.
    • Unpaid fees or fraudulent chargebacks.
    • Government requests or legal issues.
    • Prolonged inactivity or unexpected technical issues.
    • Fraudulent or illegal activities.
  • Termination may result in content deletion and permanent access restriction.

4.4 Copyright Infringement

  • If a user violates copyright or trademark rights, report it using Tune-Up Skills Intellectual Property Policy.

5.0 Tune-Up Skills Rights to Content You Post

5.1 Ownership & Licensing

  • You retain ownership of your content, but by posting it, you grant Tune-Up Skills:
    • A worldwide, non-exclusive, royalty-free license to use, modify, distribute, and promote your content.
    • Permission to syndicate and share content with third parties for marketing and distribution.
  • Tune-Up Skills has the right to modify or edit content as necessary.

5.2 No Compensation

  • By posting, you agree that no compensation will be given for Tune-Up Skills use of your content.

6.0 Using Tune-Up Skills at Your Own Risk

6.1 Content Disclaimer

  • Tune-Up Skills does not review, verify, or edit content for legal accuracy.
  • Content may be inaccurate, misleading, or objectionable—you access it at your own risk.

6.2 Health & Safety Risks

  • Courses on health, wellness, and physical exercise come with inherent risks (e.g., injury or illness).
  • By accessing such content, you assume responsibility for any risks involved.

6.3 Personal Information & Privacy

  • Be cautious when interacting with instructors or students.
  • Do not share personal information like your email or contact details.
  • Tune-Up Skills is not responsible for what users do with shared information.

6.4 Third-Party Links

  • Tune-Up Skills may link to external websites but does not control their content or policies.
  • Read third-party terms and privacy policies before engaging with their content.

7. Tune-Up Skills Rights

7.1 Ownership and Intellectual Property

  • Tune-Up Skills owns the platform, website, apps, API, databases, and all content created by its employees or partners.
  • Tune-Up Skills name, logos, trademarks, and brand features are protected by copyright and trademark laws.
  • You may not use, copy, or modify any part of Tune-Up Skills intellectual property without authorization.
  • Any feedback, comments, or suggestions you provide can be used freely by Tune-Up Skills without obligation or compensation.

7.2 Prohibited Actions

You may not:

  • Access or tamper with non-public areas of the platform.
  • Bypass security features or test vulnerabilities of Tune-Up Skills systems.
  • Reverse engineer, copy, or modify any part of Tune-Up Skills platform.
  • Use automated methods (bots, scrapers, spiders) to search or access the platform.
  • Send misleading emails that falsely appear as Tune-Up Skills communications.
  • Interfere with or disrupt the platform, such as by spamming, flooding, or overloading the system.

8.0 Subscription Terms

8.1 Subscription Plans

  • A Subscription Plan grants you a limited, non-exclusive, non-transferable license to access content.
  • You cannot share, transfer, or assign your subscription to anyone else.
  • Subscription Plans may include Interactive Sessions (third-party services) that have separate terms you must follow.
  • Some plans may include access to Generative AI Features, subject to additional terms.
  • Tune-Up Skills may revoke access to subscription content at any time for legal or policy reasons.

8.2 Account Management

  • Canceling Your Subscription:
    • You can cancel your Subscription Plan by following the steps on Tune-Up Skills Support Page.
    • Your access will continue until the last day of your billing period.
  • Refunds & Credits:
    • No refunds or credits are given for subscription cancellations, unless required by law.
  • Account Status:
    • Canceling a subscription does not delete your Tune-Up Skills account.

9. Miscellaneous Legal Terms

9.1 Binding Agreement

  • By registering, accessing, or using Tune-Up Skills Services, you agree to a legally binding contract with Tune-Up Skills.
  • If you disagree with these Terms, do not register or use the Services.
  • If you’re using Tune-Up Skills on behalf of an organization, you confirm you have the authority to accept these Terms.
  • English Language Prevails: If there’s a conflict between versions of these Terms in different languages, the English version takes precedence.

9.2 Disclaimers

This section is all about limiting Tune-Up Skills liability and protecting the platform from potential legal trouble caused by users. Here’s a quick breakdown:

  • Disclaimers: Tune-Up Skills provides the platform “as is,” meaning they don’t guarantee it will always work perfectly or that all content will be 100% accurate or reliable. They also aren’t responsible for outages, misleading instructor content, or security issues.
  • Limitation of Liability: If something goes wrong (like an injury from using a physical exercise training course), you can’t sue Tune-Up Skills for more than $100 or the amount you paid in the last 12 months.
  • Indemnification: If your actions lead to legal trouble for Tune-Up Skills (like posting copyrighted content without permission), you have to cover their legal costs.

9.3 Governing Law and Jurisdiction

When these Terms mention “Tune-Up Skills,” they’re referring to the Abidorch Consultancy Inc. entity that you’re contracting with. If you’re a student, your contracting entity and governing law will generally be determined based on your location.

9.4 Legal Actions and Notices

This clause sets a time limit on legal claims related to the agreement:

  • You (or Tune-Up Skills) must file any lawsuit within one year of the issue occurring.
  • If you wait longer than a year, you lose the right to take legal action.
  • However, if local laws prohibit such a time limit, then the legal time frame in your jurisdiction applies instead.

This is important because some jurisdictions allow longer periods to file claims, but Tune-Up Skills is limiting it to one year where legally possible.

9.5 Relationship Between Us

This clause clarifies the legal relationship between you and Tune-Up Skills:

  • You are not an employee, agent, or partner of Tune-Up Skills.
  • Using Tune-Up Skills platform does not create a joint venture, partnership, or contractor relationship.
  • You cannot act on behalf of Tune-Up Skills or claim to represent them in any way.

Essentially, Tune-Up Skills is stating that users (students or instructors) are independent parties and that the platform is just a service provider, not an employer or business partner.
